Ginlaragway nga “unprecedented” kag “unexpected” ni Atty. Jeremy Moreno, professor sang University of San Agustin College of Law, ang pagbalik sang Senado sa Kamara sang impeachment complaint batok kay Vice President Sara Duterte.

Sa interview sang Bombo Radyo, ginpahayag ni Atty. Moreno nga wala ginpaabot sang madamo nga nagabantay sa impeachment proceedings nga i-remand sang Senate ang complaint sa House.

“Actually this is also unprecedented and unexpected, because we’ve also been following the proceedings in the Senate kag wala kita naka-expect man nga i-remand gali nila, we are expecting that they will be setting this stage for that trial proper, pero kay gin-remand sang Senate, ang complaint subong complaint ara sa House of Representatives, for the purpose of certifying nga wala nila gin-violate ang ‘one-year bar’ rule in the filing of an impeachment complaint against an impeachable official.”

Ginklaro man niya nga bisan ginbalik ini sa House, indi buot silingon nga gin-dismiss na ang kaso.

“But may caveat man of course ang Senate as an Impeachment Court nga pag-remand nila sang Articles of Impeachment, they did not mean that they have dismissed the case.”

“Bantayan naman naton subong kung ano naman ang action sang House of Representatives regarding sa remanding back sang Articles of Impeachment sa ila by the Senate as an Impeachment Court.”

Ginpaathag man ni Moreno nga ang pag-issue sang summons kay Vice President Duterte nagpamatuod nga ara gihapon sa hurisdiksyon sang Impeachment Court ang kaso.

“That’s correct, still it expressly said that it retains jurisdiction because it did not dismiss the case so ang action ni Senate President Escudero and the Impeachment Court is to issue summons to Vice President Duterte para maka-formally file siya sang ginatawag naton nga responsive pleadings which is her answer and she is given 10 days to file and the prosecution 5 days to file a reply.”

“We will see kung ano ang next steps sang Senate as an Impeachment Court after man maka-file si Vice President sang iya nga answer.”

Sa pamangkot kun magapadayon bala ang desisyon kung madayon ang pagbasa sang articles of impeachment subong nga adlaw, ini ang sabat ni Atty. Moreno:

“At this point indi na kita makasiling kung maka-proceed pa siya or indi na, because the Impeachment Court are taking steps, kag ang kopya ara pa sa House… pero kung mag-proceed ang Senate as an Impeachment Court to have the Articles read, if it is within their rules of procedures kay allowed man ang Senate as Impeachment Court nga mag-establish or promulgate sang ila own rules to proceed.”

Sa posibilidad nga magbalik ang complaint sa Senate, ini ang iya panan-awan:

“House could also reject the remanding because para sa iya wala sang power ang Senate as an Impeachment Court to remand the case back but kung mag-comply na man lang si House, it will certify the Articles of Impeachment and return it back to the Senate as an Impeachment Court and if wala naman sang procedural obstacles regarding sa pag-proceed sang trials, so I think after the return of the complaint of the certified complaint dara na gid ma-proceed ang trial kay Vice President Duterte in accordance sa procedure sang Impeachment Court.”
