Sa desisyon sang Comelec First Division nga napetsahan sang Disyembre 18, ginpahayag nga kulang ang gin-presentar nga ebidensya sang petitioner kag wala sini na-kumbinse ang division nga ideklarar ang respondent bilang nuisance candidate sa palaabuton nga eleksyon.
Ini nga resolution sang poll body ang pirmado nanday Comelec commissioners Socorro Inting, Aimee Ferolino, kag Ernesto Ferdinand Maceda Jr.
Kun matandaan, ang labor leader nga si Sonny Matula amo ang nag-file sang petisyon nga i-disqualify si Quiboloy bangud sa ginaalegar nga “material misrepresentation”.
Ginpahayag sini nga ang ginplastar ni Quiboloy nga nominasyon halin sa Workers’ and Peasants’ Party (WPP) ang wala sang matuod kag legal nga basehan.
Sang amo nga tion, ginbutang ni Quiboloy sa iya nga certificate of nomination and acceptance (CONA) ang pirma ni certain Mark Tolentino, apang suno kay Matula, indi matuod nga halin ini ukon miyembro sang WPP.
Suno naman sa Comelec, wala naka-comply ang petitioners sa procedural rules bangud ang ila petisyon nga ideklarar si Quiboloy bilang nuisance candidate ang gin-impunan sang iban pa nga grounds kag remedies.
Suno pa sa poll body, ang petisyon ni Matula ang naghatag sang grounds nga indi husto kag wala sang “factual” kag “legal evidence.”
“The Petitioner maintained that Respondent’s submission of an unauthorized CONA was a violation of WPP’s and this Commission’s rules, and that it was a clear ground for the cancellation of his COC. We do not agree,” suno sa desisyon sang Comelec.
“It could be determined that the argument relied upon by the Petitioner is patently erroneous. When the Commission denies due course to or cancels a candidate’s COC, this is due to a finding that the candidate made a material misrepresentation in his or her COC which is false… Clearly, membership or nomination by political party is not among the qualifications for the position of Senator. Thus, the submission of a CONA that was signed by unauthorized individual is not equivalent to material misrepresentation that will affect the Respondent’s eligibility,” pagpadayon pa sang poll body.
Sang Oktubre 21, matandaan nga nagpahayag ang kampo ni Quiboloy nga magapadalagan na lamang ini bilang independent candidate sa 2025 elections.
“Given the ongoing intra-party dispute, I am revoking my acceptance as a nominee of WPP. I am therefore running as an independent candidate for senator in the 2025 NLE,” kabahin anay sang statement sang pastor.
