Former President Rodrigo Duterte’s request for interim release from the International Criminal Court (ICC) is unlikely to be approved due to concerns that he may evade legal proceedings, according to a criminal defense lawyer.
In an interview with Bombo Radyo, Atty. Nelson Borja explained that granting Duterte temporary freedom could pose a risk, as he might refuse to return for trial.
Borja also pointed to recent protests by Duterte’s supporters in both the Netherlands, where the ICC is headquartered, and the Philippines. He suggested that these demonstrations highlight the former president’s strong influence, which the ICC may take into account when assessing his case.
While the ICC allows detainees to request interim release, Borja stressed that such appeals must show “extreme and urgent necessity.” He added that Duterte’s legal team may find it difficult to justify the request based on health reasons.
However, he noted that Duterte could still secure his freedom if the ICC dismisses the case due to jurisdictional issues or if he is acquitted.
Duterte made his first appearance before the ICC via video conference last Friday. He is facing charges of crimes against humanity over his administration’s war on drugs.
The next hearing, set for September 23, 2025, will focus on whether the charges against him will be confirmed.
Borja also expressed his willingness to be part of Duterte’s defense team if given the chance. He further emphasized the importance of having Filipino lawyers with ICC expertise to handle the case.
