The Commission on Elections (COMELEC) First Division has dismissed the disqualification petition filed against the Bagong Henerasyon party-list, citing technical grounds.
COMELEC Chairman George Erwin Garcia explained that the case was junked due to procedural issues and did not reach a decision based on the merits of the complaint.
Despite the dismissal, the party-list cannot be proclaimed just yet. The decision is not yet final and executory, as the petitioner is given five days to respond. If no response is filed within that period, the ruling becomes final, and a special proclamation for Bagong Henerasyon will follow.
The case highlights the importance of legal technicalities in election-related petitions and underscores the procedural hurdles before a party-list can be officially proclaimed.
