Wala sang nakit-an nga legal issue ang Department of Justice (DOJ) pananglitan isaylo sa Office of the President (OP) ang Philippine Health Insurance Corporation (PhilHealth) nga isa ka attached agency sang Department of Health (DOH).
Nakasaad ini sa legal opinion nga ginpaguwa ni Justice Usec. Raul Vasquez.
Suno sa amo nga opinyon, pananglitan isaylo gid man ang Philhealth, isa ini ka lehitimo nga paggamit sang power of control sang presidente sa executive department, bureaus, kag sa offices nga naga- justify sang executive action nga himuon ang reorganization measures agud mas mangin epektibo ang bureaucracy.
“We advise that there is no legal issue on the possible transfer of the PhilHealth to the OP as it is a legitimate exercise of the President’s power of control over the executive department, bureaus and offices, which justifies an executive action to carry out reorganization measures to ensure an efficient bureaucracy,” kabahin sang legal opinion.
Matandaan nga sang Hunyo 26, nagsulat si Vasquez kanday Health Usec. Kenneth Ronquillo kag sa Presidential Management Staff bilang sabat sa ila request sa legal opinion sa amo nga proposal.
Ang pagsaylo sang opisina sang Philhealth suno kay Health Secretary Teodoro Herbosa amo ang paagi agud nga mapauswag ang efficiency sa government health insurance.
Ginsaad naman ni Vasquez ang Administrative Code of 1987 nga may gahum ang presidente nga organisahon ang iya nga opisina agud nga malab-ot ang tuyo nga simplicity, economy kag efficiency sa panggobyerno. #
